What we provide

  • Business use only – Our financing is for business purposes, never personal use.

  • US businesses – We fund businesses based in the United States.

  • Final once signed – An offer isn't a commitment until it's signed.

What we ask of you

  • Accurate information – What you tell us must be true and complete.

  • Authority to sign – You must be authorized to act for the business.

  • A secure password – You're responsible for activity on your account.

How we contact you

  • Email – Updates about your application and account.

  • Underwriter calls or texts – Only to clarify information on your application.

  • No marketing – We never call or text you to sell anything.

Agreement to these terms

By using the Funded Experts website, applications, and services ("Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services.

You must be at least 18 years old and authorized to act on behalf of the business you represent. By submitting an application or accepting an offer, you confirm that you have the legal authority to bind that business.

We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the new Terms.

Our service

Funded Experts provides commercial financing directly to small businesses. We are the direct funder—we underwrite, approve, and fund every transaction ourselves. We do not broker applications to third-party lenders or funding partners.

Our service includes: (a) an online application that collects business and financial information; (b) underwriting analysis based on the information and bank statements you provide; (c) presentation of financing offers that we fund directly; and (d) servicing of the financing throughout its term.

The application suggests addresses as you type, using a third-party address-lookup service. The suggestions are a convenience and are not verified by us; you are responsible for confirming that the address you submit is accurate and complete.

An offer presented through our platform is not a commitment to fund until you sign the funding agreement and all conditions are satisfied, including identity verification and any other conditions specified in the offer.

All financing we offer is commercial financing for business purposes only. It is not a consumer loan, personal loan, or consumer credit product. By applying, you certify that the financing will be used solely for business purposes.

Your account

If you create an account (as a broker, ISO, or other partner), you must provide accurate and complete information. You are responsible for maintaining the security of your password and for all activity that occurs under your account.

You must notify us immediately if you suspect any unauthorized use of your account. We are not liable for losses resulting from unauthorized access to your account.

We reserve the right to suspend or terminate your account if you violate these Terms, provide false information, or engage in fraudulent or illegal activity.

Electronic communications

You agree to receive communications about your application and account electronically, including by email. An underwriter may also call or text the phone number you provide to clarify information about your application. We do not use your phone number for marketing.

You may opt out of non-essential electronic communications by following the unsubscribe link in any email or by contacting us. Opting out may prevent you from receiving important updates about your application or account.

Limitation of liability

To the fullest extent permitted by law, Funded Experts and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from or related to your use of the Services.

Our total liability for any claim arising from these Terms or the Services shall not exceed the greater of (a) the fees you paid to us in the twelve months preceding the claim, or (b) $100.

We do not guarantee that any financing offer will be presented, that any offer will be funded, or that the Services will be uninterrupted or error-free. The Services are provided "as is" and "as available" without warranties of any kind.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Any dispute arising from or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction of those courts.

We each agree to bring any claim individually, not as part of a class action or representative proceeding. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
